On May 20, 2021, the California Senate is scheduled to vote on Senate Bill 545. This legislation would require school districts to retain a student for the 2021-2022 school year, if requested by a parent or guardian. This is important legislation for all students who have suffered with distance learning. The bill would also mandate that the school district allow access to to courses from the prior semester in which the studentreceived a D or F, or to offer some other form of... credit recovery, and to provide parent with information about research on the effects of pupil retention, and the types of interventions and supports that have been shown to be beneficial. The bill would impose a state-mandated local program and would go into effect immediately. Do you know the difference between a 504 Plan and an IEP? An Individualized Education Progran (IEP) provides special education and related services, which can also include accommodations. A student may be eligible for an IEP if the student meets one of the 13 qualifying eligibility categories AND if the student’s disability impacts the child’s educational performance and/or ability to learn and benefit from the general education curriculum. A 504 Plan provides services and c...hanges/accommodations to the learning environment to enable students to learn alongside their peers. Section 504 has a broader definition of a disability than IDEA. It says a disability must substantially limit one or more basic life activities.
