It's happening again! The cap on Actual Primary Losses (APL) used to calculate the Workers Comp Experience Modification Rating (EMR) is changing effective January 1st, 2017. Since 2012, the Primary Threshold (cap on APL) for each claim was $7,000, for all employers. Now the Primary threshold will range from $4,500 to $75,000, depending on the size of the employer. This is significant because the formula used to derive EMR is heavily weighted on the APL portion of each claim,... with less weight being applied to the portions of claims above the Primary Threshold (Actual Excess Losses). Higher Primary Thresholds = higher EMR if there are claims that exceed $7,000 for medium and large employers.
