Attorney Fees to Individual Clients Please note that attorney fees are no longer deductible by individual clients, regardless of the case. Since miscellaneous expenses have been eliminated from the schedule A Itemized Deductions, individuals will no longer be able to deduct the cost of legal fees. The saving grace is that under prior law most individuals were not really benefiting from the deduction of legal fees. This was due to most individuals ending up in AMT given the large judgements they were winning. When in AMT, miscellaneous expenses were excluded. I can show you how much of your judgement you actually get to keep both under prior law and under the new Tax Cut & Job Act. Call to make an appointment.
