Good day for client, 20.48 Kilo Methamphetamine border bust: Client was the sole owner and driver of car containing 20.48 kilos of methamphetamine in the gas tank. While crossing the border, drug detection dog alerted to the gas tank. Client was sent to secondary and questioned. She denied knowledge of the drugs. Client was offered a plea deal. Had she taken it would have been looking at a range of two to four years in prison. She maintained her innocence and we set the case ...for trial. Risk of going to trial and losing was about nine to eleven years in prison. With luck we could have reduced it to less than four. After filing our motions in limine, and preparation for trial. Government submitted a motion to dismiss the case. The judge just signed the order yesterday and client has been released and is back at home. In the words of my friend Vince Tucci, Good things happen, when you answer ready for trial. This is my fourth Federal case dismissed after setting for trial since 2013.

GOOD DAY FOR CLIENT Client charged with importing 7.04 kilo’s of methamphetamine. A street value of over $500,000.00, according to case agents. Government filed a superceding indictment adding conspiracy and increasing prison exposure. After 5 months in custody and seven days before Jury Trial, Judge just signed his order for dismissal. His initial offer placed him in the range of about 9 years in prison. He rejected the offer maintaining his innocence. By refusing the offer his prison exposure if we lost was about 19 years with 10 year minimum mandatory. One more happy client who will soon be reunited with his family.

Last year I had the pleasure and honor of second chairing this Federal Drug Smuggling trial. I learned a lot from that trial, and am planning on using some of what I learned in trial defending a similar case next month. Mr. Sivilla will get second opportunity.
