I recently watched a court of appeal argument (while waiting, the bane of lawyers everywhere, for my client's case to be heard) about the effects of the 200 PAGA law. That law allows one employee whose employer has allegedly stolen wages from the employee to sue for themselves and for all other employees who are being the treated the same by the employer. PAGA allows the employee to recover 25% of $100 per day penalties against the offending employer. It's a powerful tool for... employees because instead of suing for only their own damages and penalties they sue for a whole class of people. This means a claim that was not monetarily viable (one person's lost wages at minimum wage doesn't amount to more than few thousand dollars) becomes monetarily viable. That means a lawyer can step in and take the case without getting paid before winning (that's what a contingency action is, the lawyer is making the bet their client will recover, no recovery, no fee). The Supreme Court just decided that PAGA plaintiffs don't recover lost wages, just the penalties. See the article. In my opinion, the appropriate balance between the preservation or historically significant sites, especially native ones, and the push towards building forward is a difficult one in society. In this case, its made even harder because of telescope will benefit future progress on learning from space. Thoughts?
