Proposition 19 was approved by California voters during the November 3rd election and makes significant changes to Constitutional provisions regarding property tax rules. Some of these changes have already gone into effect and others will go into effect April 1st. Here’s what you need to know: Seniors & Disabled... Proposition 19 will allow those over the age of 55, the severely disabled, and victims of a natural disaster, such as a fire, flood or earthquake, to transfer their current property assessment and the property tax basis when they sell their home and buy a new one. Eligible homeowners can now purchase a new home of any value anywhere in the state and take their lower property tax basis with them. Further, it allows them to transfer their tax basis up to three times. For many seniors who were reluctant to move and risk higher property taxes, Prop. 19 will provide an opportunity to upgrade or downsize in the California community of choice. Inheritance of Family Property If you are to inherit a family property from your parents, Prop. 19 limits some tax benefits that previously existed. Under the previous law, parents could pass-down a family property to their children and the assessed value for property tax purposes would remain unchanged. This translated to valuable property tax savings for many working and middle-income families. Now, only a parent’s principal residence may be transferred to their children, and that home must then become the child’s principal residence within one-year of the transfer. If these conditions are not met, the home will be reassessed to market value and the property taxes may increase. Legislation still needed Prop. 19 still requires clarification by the State Legislature to clarify and address ambiguities in the new law in order to avoid confusion and uneven application of practices across the state. I am working to advance legislation to address these issues. Senate Bill 539, authored by Senators Bob Hertzberg, Mike McGuire, and Ben Allen, aims to clarify several key points that are essential for the fair administration of the law, but the legislation only addresses a portion of what is needed to implement the entirety of Prop. 19 and additional legislation is still needed.

California Tax Relief In the last couple of days, Governor Newsom issued an Executive Order granting special tax relief for California taxpayers impacted by the COVID-19 pandemic. This means you will have extra time to file and pay your California taxes. This relief includes moving the various tax filing and payment deadlines that occur on March 15, 2020, through June 15, 2020, to June 15, 2020. This includes:... Partnerships and LLCs who are taxed as partnerships whose tax returns are due on March 15 now have a 90-day extension to file and pay by June 15. Individual filers whose tax returns are due on April 15 now have a 60-day extension to file and pay by June 15. Quarterly estimated tax payments due on April 15 now have a 60-day extension to pay by June 15. Taxpayers claiming the special COVID-19 relief should write the name of the state of emergency (for example, COVID-19) in black ink at the top of the tax return to alert FTB of the special extension period. If taxpayers are e-filing, they should follow the software instructions to enter disaster information. The FTB’s June 15 extended due date may be pushed back even further if the Internal Revenue Service grants a longer relief period. Finally, FTB will also waive interest and any late filing or late payment penalties that would other wise apply. Federal Tax Relief The Federal government has also stepped up in a big way. This morning, Treasury Secretary Mnuchin announced in a press conference that taxpayers will receive the following relief: For individuals owing tax, you may defer up to $1,000,000 of tax payments, interest and penalty free for 90 days. Businesses and corporations may defer up to $10,000,000 of tax payments, interest and penalty free for 90 days. Details will be forthcoming, but if you owe tax, you can file in the normal course and you will be automatically exonerated from penalties and interest up to July 15, 2020. You may still extend your tax return, of course, but if you think you can pay within that time frame of 90 days, you have nothing to lose by filing. Be safe!

Assessor Warns Homeowners of Real Estate Fraud and Misleading Solicitations LOS ANGELES, CA Assessor Jeffrey Prang is alerting all property owners of increasing reports of deed scam solicitations and misleading mailings being sent across the county. Television and radio advertising that urges property owners to protect their homes from theft by unauthorized changes to deeds and other legal documents has caused concerns among residents, who have approached the Assessor wanti...ng to know how best they can protect themselves from falling victim to identity fraud. Given the seriousness and frequency of both cyber threats and identity theft, the Assessor together with Board of Supervisors and county agencies already implement a notification system which alerts property owners of any change to a deed, deed of trust, or similar document recorded with the County of Los Angeles. Under the "Notice of Recordation" law in place since 2012, the last owner of record is mailed an official notification whenever a chance to a deed or deed of trust is recorded. This notice provides the lawful owner advance notice and the opportunity to challenge any changes to ownership documents. Mailed solicitations designed to appear as though they originated from the Assessor or another government agency, with stern warnings of fines and imprisonment, ask property owners to pay fees in order to obtain information already available to them for free. These solicitations are professionally designed to look official and include similar barcodes and phrasing, such as "Recorded Deed Notice." One example charges a fee for a property assessment profile that can be obtained for free from the Assessor. In fact, this assessment information is available at no cost 24 hours a day, 7 days a week directly through the Assessor's office at portal.assessor.lacounty.gov. Assessment data is also available during business hours by phone at 213-974-3211 or 888-807-2111, in person, and via email at [email protected]. "Homeowners should always be vigilant of attempts at theft that can lead to changes affecting legal documents and property ownership," said Assessor Jeffrey Prang. He continued, "I am also pleased to offer property owners an alternative to obtaining valuable assessment data so that they do not have to rely on fee-based services for information that I believe ought to be free and readily accessible to the public. Our award-winning portal should be the first resource for any property owner or real estate professional." Assessor Prang asks homeowners to report suspicious solicitations.
