On May 10, 2019, U.S. Customs & Border Protection (CBP) provided updated guidance to the importing community with respect to the recent increase in duty rates for Chinese-origin goods listed on Sec. 301, Tranche 3. CBP specified in CSMS #19-000238 that goods exported before May 10, 2019 must be entered in the U.S. or withdrawn from warehouse before June 1, 2019 in order to qualify for the lower 10% additional duty rate that has been in effect since September 2018. Goods entered on June 1, 2019 or later will be subject to a 25% additional duty rate irrespective of the date of export. The additional tariffs apply to goods of Chinese origin, regardless of where they are exported from. Should you have questions regarding the Sec. 301 tariffs, please contact our office.

This past Thursday September 23rd, Office of the United States Trade Representative issued it new list of additional 10% - 25% ad valorem tariffs which are to be added on top of the current published tariff rates. Like last July's ad valorem tariff list, it would not be surprising to see the new list applied in the same manner. What does this mean for you? Well, it means a few thing, most importantly it may indeed increase you landed duty paid cost by as much as 25% on cost ...of material/goods. This is no little figure to shrug your shoulders at, considering most businesses run at or near a 20% margin, this could wipe out your profits and leave you noncompetitive in your market. Further, these new costs may not have even hit your books yet, pending your brokers notification of increased duty invoices or your A/R department yet to process these new fees. Worse, you have no idea what I'm talking about because your logistics department and/or service provider aren't up to speed with the rapid changing import environment. What can you do? Talk to your logistics team and/or logistics provider, see what they know, are they aware of these new ad valorem tariffs, are they affecting your products? If they don't have the answers you need readily available you could be in for some big, scary surprises in the form of additional duty invoices! Can you risk being caught unaware, unprepared and under serviced? New China Customs Advanced Manifest(CCAM): Effective June 1, 2018, Chinese Customs will require additional data supplied via carriers on both the master and house transport documents. This impacts all cargo going to and from Chinathe new regulations are applicable to all import, export and transshipment cargo via all ports and all modes of transport. For all cargo, the manifest must be complete and accuratein accordance with additional requirementsand submitted to China Cu...stoms electronically 24 hours prior to vessel loading at origin. U.S. Exports to China The Shipper at origin will be required to provide the below additional data elements:. 1. U.S. Shipper (Consignor) Company Code EIN Number. 2. U.S. Shipper (Consignor) Phone Number 3. U.S. Shipper (Consignor) AEO (Authorized Economic Operator) Status (Optional) 4. Chinese Consignee Company Name 5. Chinese Consignee Company Code Tax ID Number / Unified Social Credit Code of 18 digits* 6. Chinese Consignee Phone Number 7. Chinese Consignee Contact Person 8. Chinese Consignee AEO (Authorized Economic Operator) Status (Optional) 9. Notify Party’s Company Code Tax ID Number* 10. Notify Party’s Phone Number If the information is not provided within the required timeframe, the Carrier will place a HOLD on the cargo to prevent loading onto the exporting vessel/aircraft. This could result in penalties, fines and/or additional costs. U.S. Imports from China The Chinese Shipper at origin will be required to provide the below additional data elements: 1. Chinese Shipper (Consignor) Company Code 2. Chinese Shipper (Consignor) Phone Number 3. U.S Consignee Name 4. U.S. Company Code Tax ID Number (mandatory if consignee is TO ORDER) 5. U.S. Consignee Phone Number (mandatory if consignee is TO ORDER) 6. U.S. Consignee Contact (mandatory if consignee is TO ORDER) 7. U.S. Consignee Contact Phone Number (mandatory if consignee is TO ORDER) 8. Notify Party’s Company Code Tax ID Number* (mandatory if consignee is TO ORDER) 9. Notify Party’s Phone Number (mandatory if consignee is TO ORDER) If the information is not provided within the required timeframe, the Carrier will place a HOLD on the cargo to prevent loading onto the exporting vessel/aircraft. This could result in penalties, fines and/or additional costs. Additionally, if an importer’s broker is a Notify party their EIN and phone number must be supplied as part of the booking process.
