This week the Law Review analyzes a Third Appellate District court case (Bustos v Wells Fargo) where Wells Fargo started foreclosure proceedings against a residential borrower WHILE she was in the process of obtaining a loan modification from Wells. A huge no-no, ‘dual tracking’ is expressly forbidden by the 2012 Homeowner Bill of Rights law enacted to prevent banks from abusing their residential borrowers. Justice Butz issues a scathing Opinion, worth reading for sure.

For years, employers have hired some employees as independent contractors, not as employees with all of the associated obligations like worker’s comp, disability, overtime, etc. Well - those days are over as of January 1 due to Assembly Bill 5. A revision to the Labor Code severely restricts when workers may be 1099’d as independent contractors. More on that in Porter's latest Law Review.
