Congratulations to Palumbo Bergstrom's Colorado Office for authoring the appellate briefs that led to this monumental decision in the state of Colorado. The Colorado Court of Appeals got it right when they upheld a provision in the Vallagio at Inverness declaration which required the declarant's consent to amend the declaration to remove the arbitration provision applicable to claims for construction defects.
