A few days ago the Trump Administration made final its new policy on the issue of Public Charge. This new rule is yet another of President Trump's maneuvers to limit LEGAL immigration. Many news outlets are reporting extreme versions of how this new rule or policy can impact the immigrant community. While this new public charge rule will definitely impact the immigrant community, it's also not necessary to cause fear. The rule is very dense and, at the same time, quite va...gue. It's over 800 pages. It's very detailed. But, discusses more than just whether anyone obtained food stamps, cash assistance or medicaid; the rule also discusses whether the individual seeking to immigrate speaks English and/or what level of education the individual has. Certainly, the sense I get is that this new Public Charge rule is the underpinnings of creating an elite migration policy....only your educated, English speaking, wealthy immigrants please. But, at the same time, it's basically up to the individual officer, as they say in the rule, to weigh the circumstances in totality. For privacy reasons, I cannot share my client's name BUT today my client was one of 10,000 people who obtained his U visa. Now, he is protected from deportation and has legal status in the United States. In three years, he will be able to apply for his lawful permanent residence...
