I hear this sometimes when I talk with business owners who want to get a trademark for their brand but decided to DIY because they simply wanted to save money. And after a few months, they come back to me sounding stressed and lost asking how to deal with USPTO messages and how to reply to office actions.... They said that they should’ve asked for my assistance in filing their trademark because they felt they just wasted time and now feeling stressed. You see, a lot of business owners want to DIY as much as they can. They want to try and learn things on their own but don't think about the resources (time, energy, and money) they can save in the long run. Don’t get me wrong - there’s nothing wrong with trying to do things on your own. But, when you want to get things done the right way so you can fast track the attainment of your goals while reducing the stress, hire a PRO who can do it for you. DIYing your trademark is good. But just make sure you learned from a PRO on how to do it so you don’t waste your precious time and money. Two years ago, I was stressing myself out trying to build my website panicking the whole time until my wonderful husband pointed out very sweetly that babe you are not a software developer or an IT professional, you’re a lawyer so go back to lawyering and hire a professional to do your website and then it hit me that I’m doing precisely what I advise my clients not to do.... When you’re a budding entrepreneur you often feel that you have to do everything yourself and getting outside help is a waste of money, so not true. I always tell my clients especially startups that please don’t download contract templates and use them thinking you’re saving money and being savvy. A template doesn’t know what your particular circumstances are and will definitely not provide you with the protection you need when you’re starting off. It’s better to spend a little bit of money, in the beginning, to save you from spending 10 times later on when you need to hire a litigation attorney to get you out of a sticky situation that perhaps could have been avoided if you had a properly drafted contract at the initial stages of a new venture. #californialawyer #intellectualpropertylawyer #trademarkattorney

Legal Zoom is not a law firm. They cannot give you legal advice or strategy advice. They cannot represent you with the USPTO.... They cannot submit legal arguments on your behalf. And that's why they're cheaper than any attorney that you'll meet here in the US. This screenshot was my response to a technical office action issued by the USPTO refusing registration because according to the PTO we didn't provide proof of use or we provided deficient specimens. That's the kind of technical conversation/exchange we have to get a mark registered. And that is why you need a proper attorney handling these applications coz they are intense and highly technical.
