Alston Lew, Associate in the firm's San Francisco office, moderated and spoke at an MCLE panel titled: How To Become Insurance Panel Counsel & Tips on Ethical Issues Arising in Representing Clients. The national convention for the NAPABA - National Asian Pacific American Bar Association took place on November 8, 2019 in Austin, TX. The conference panel focused on how insurance panel attorneys and staff counsel balance the unique tripartite relationship where insurance defens...e attorneys represent clients that are insured by insurance carriers, but the carriers foot the costs and expenses related to litigation. The panelists discussed the ethical conflicts that can arise through such representation between representing policyholders/insureds, but having to communicate with insurance carriers and how different states have variations on dealing with this type of representation. Additionally, the panel discussed business development and how attorneys can approach obtaining new business from insurance carriers as well as how to develop relationships with insurance carriers to be considered for panel counsel work.
