Byrdsong, who will provide practical trial tips and guidance on admitting and showcasing ESI evidence at trial, as well as trial technology. The first panel will be on Obtaining ESI in discovery - challenges, disputes, and accessibility and will feature dynamic and experienced practitioners, Gina Browne and Tom Barnett, a forensic expert, and Jane Tanimura who will be moderating. The first panel, which includes both plaintiff and defense practitioners, as well as two retired judges who serve as arbitrators, will take an in-depth look at arbitration, including such issues as drafting arbitration agreements, new Labor Code section regarding contracts wi...th arbitration forum selection; Armendariz factors; class action waiver; procedural concerns, including under-utilized rules or procedures; picking an arbitrator; arbitrability issues (who decides what?); arbitration discovery rules vs. the CCP; cost-benefit analysis of dispositive motions; motions to compel; and post-arbitration appellate issues. The second panel will focus on appellate pitfalls to avoid during litigation, as presented by an Associate Justice of the Court of Appeal and a seasoned appellate practitioner.
