Pappas (Manning & Kass, Ellrod, Ramirez, Trester) FACTS: On July 22, 2016, Ian Dotson was under the care of Aacres, LLC. Aacres is a residential care facility for young adults with developmental disabilities. Its staff took Ian to the Orange County Fair. He wandered off. He was hit by a car traveling 45 mph. Dotson filed a lawsuit. PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant's supervision was negligent and caused plaintiff to hit by the vehicle. Plaintiff contended that his injuries were severe and life threatening. DEFENDANT'S CONTENTIONS: Defendant contended that it acted reasonably. Defendant contended that developmentally disabled individuals are unpredictable and have a tendency to wander off. RESULT: The jury found for plaintiff. It awarded $6.2 million in aggregate damages: $106,000 in past medical damages, $600,000 in future medical damages, $2 million in past non-economic damages, and $3.5 million in future non-economic damages.
