COVID-19 and Public Charge: All noncitizens should get the care they need. USCIS announced that testing, treatment and preventive care (including a vaccine if one becomes available) for COVID-19 will not be considered in the public charge test. These services will have no negative impact, even if such treatment is provided or paid for by one or more public benefits, as defined in the rule (e.g. federally funded Medicaid). These services also will not impact nonimmigrants se...eking an extension of stay or change of status. Additionally, if a person subject to public charge ground of inadmissibility lives and works in a jurisdiction where disease prevention methods such as social distancing or quarantine are in place, or where the person’s employer, school, or university shuts down operations to prevent the spread of COVID-19, they may submit a statement with their application for adjustment of status to explain how such methods or policies have affected the factors USCIS must consider in a public charge inadmissibility determination.

MGC Law, APC. will be in limited operations until the end of the month. At that time we will re-assess how we will proceed. To ensure the well being of our employees, clients and the community, we have implemented the following guidelines: We encourage our ...employees to wash their hands regularly and stay home when sick to prevent the spread of germs to others and hand sanitizers are available for all of our employees; Out of abundance of caution, we are embracing social distancing strategies to limit viral spread. As such, we will continue to work both in the office, remotely and appearing in all court cases that are allowed by the corresponding court. All new client consultations will be administered telephonically for those clients that need immediate representation (i.e., those detained). All other new client consultations will be scheduled for after March 31, 2020. For all of our clients who already had appointments scheduled during this time and cannot proceed with your appointment telephonically (i.e., you’re coming in to turn in or sign documents), we will honor your appointment and diligently continue to work on your case but ONLY THE PERSON WITH THE APPOINTMENT will be allowed in the office. No accompanying children, friends or family will be allowed to come in with you as we have limited space.
