I am an attorney who specializes in assisting parents with children who have Special Educational needs ensure that their child has Free and Appropriate Public Education (FAPE). In short, I advocate for parents whose child has a particular educational need of any kind, including learning disabilities, physical limitation, mental limitation, twice-exceptional, ASD, OCD, and Other Specified Health needs. These children, under the law, are entitled to the same opportunity to ac...cess public education as their neurotypical peers. During this time of COVID-19, some parents are at home, with special needs children, attempting to educate and support their unique educational requirements. The school district MUST provide some support and guidance to these parents and children. As you likely know, both the California legislature and Congress are considering FAPE waivers on behalf of school districts which would suspend the rights of students with disabilities rights under the IDEA and Section 504. Please see the COPAA Action Alert below. For those of you not familiar with COPAA, it is the parent, attorney, advocate organization advocating on behalf of students with disabilities. This is critical for all of us to do in California specifically as th...e public schools have started approaching California legislators to remove IDEA protections for students with disabilities.
