I am honored and delighted to be participating in the 16th ICC International Commercial Meditation Competition as a judge and as a mediator from 5-11 February 2021. The ICC’s largest educational event will be delivered online in its 16th edition. The Competition gathers students and coaches, together with 100 professional mediators and mediation trainers from all over the world. During the Competition, students representing 45 universities from 39 countries will compete to resolve international business disputes through mediation for a chance to be the ICC’s International Commercial Mediation Competition champion. Dozens of minors, through their parents, have filed lawsuits against TikTok, ByteDance, and others in U.S. district courts. The gravamen of the lawsuits is that the TikTok app allegedly collects information about users’ facial characteristics, locations, and close contacts, and subsequently transfers the data to servers in China, in violation of law. Twenty separate, similar lawsuits have been filed in the past year on behalf of users in California and Illinois. The lawsuits ...have been merged into one consolidated case. A nationwide class-action lawsuit is expected to enlarge the consolidated lawsuit. The current U.S. administration considers the app a national security risk, asserting that the platform is a surveillance site rather than a social media site. TikTok is required to be sold to a U.S. company by mid-September or cease operations in the U.S. Microsoft has expressed interest in purchasing TikTok. TikTok is seeking to dismiss the consolidated lawsuit, relying on an arbitration clause in the user agreement arguably requiring that all disputes arising thereunder shall be decided by arbitration. Plaintiffs assert that the arbitration clause does not apply to minors.
