CITY ADVISORY: Clarification regarding short-term lodging under Governor’s Regional Stay At Home Order Dec. 9, 2020 Following the Governor’s Dec. 3, 2020 Regional Stay at Home Order, there was some confusion over what types of short-term lodging operations would be allowed to continue to operate.... On Monday, Dec. 8, 2020, the City of Palm Springs and other Riverside County cities received clarification from the County of Riverside with the following restrictions in order to operate. For instate visitors, short-term lodging (including hotels, motels, vacation rentals, and time shares) will continue to be able to operate as long as those visitors are either: (1) essential workers; or (2) traveling for COVID-19 mitigation and containment measures, treatment measures, or providing housing solutions, including measures to protect homeless populations. For out of state visitors, a separate rule applies. Short-term lodging is allowed to continue to operate and be available if either: (1) those visitors are essential workers; or (2) those visitors are traveling for above-referenced COVID mitigation purposes; or (3) those visitors are traveling for non-essential travel, but the reservation is for at least the minimum 14-day time period required for quarantine. In addition, to these rules, the following regulations apply to retail, grocery stores and restaurants: Retail: Allow indoor operation at 20% capacity, and 35% of capacity for standalone grocery stores, with entrance metering and no eating or drinking in the stores. Additionally, special hours should be instituted for seniors and others with chronic conditions or compromised immune systems. Restaurants: Allow only for take-out or delivery. No in-person dining allowed, whether indoors or outdoors, including patio dining. In addition to these rules, proprietors should also consult their insurance policies regarding coverage. NEWS RELEASE - New Palm Springs City ordinance limits third-party food delivery service fees Dec. 9, 2020 In an effort to prevent food delivery services from overcharging customers and businesses during the COVID-19 pandemic, the City Council recently approved a new ordinance that limits fees that providers such as Uber Eats, Postmates and DoorDash, may charge residents and businesses.... The new Ordinance establishes the following limitations: Food delivery services cannot charge more than a 15% delivery fee on the purchase price of each online order. No more than 5% of the purchase price can be charged to the business for any combination of service fees. All tips must go exclusively to the driver. Example: If a customer orders a meal that is advertised at $10 on the third-party delivery service’s app, the delivery service cannot charge more than $10 for the meal. Nor can the service provider charge the restaurant more than $1.50 as a delivery fee -- or the restaurant more than 50 cents as a fee or commission for their placement on the delivery service’s app. If the customer agrees to provide the delivery person a $2 tip, that tip amount must go to the delivery person; not the third-party delivery service company.
