Fanciful marks do not describe the good or service to which they relate and also happen to be the most likely marks to register. In other words, if a mark does not give indication what the goods are then it has a higher chance at registering. The downside, of course, is that the customer knows nothing about the goods so you need to educate the consumer more. Famous example - the APPLE trademark for computers. #TrademarkTuesday

On this #GivingTuesday (also #TrademarkTuesday), we had to look up whether there were any trademark rights associated with the source, GivingTuesday, an independent nonprofit organization. We did not find any but ultimately, the organization's goal is "to create a more just and generous world, one where generosity is at the heart of the society we build together, unlocking dignity, opportunity, and equity around the globe." The logo treatments change every year and can be use...d freely by other organizations without permission. And, for those very reasons, cannot be trademarked. Checking out the USPTO for recent filings using the word VOTE. Not at all surprising that there are MANY filings - I AM THE VOTE, GENERATION VOTE, BABE VOTE, VOTE OR DIE!, VOTE TO LIVE, MY VOTE IS MY PROTEST, VOTE LIKE YOU HAVE NO PRIVILEGE, VOTE 2020...the list goes on. Most of these marks were filed in connection with clothing or other promotional items and unless they are using the mark as a brand rather than "decoratively" on the front of a t-shirt or cup, they are unlike...ly to get those marks registered. But, the message is clear - VOTE. #TrademarkTuesday
