Joe Biden has vowed to reverse the harsh and anti-immigrant policies established by President Trump. In so doing, he has stated that his government will welcome the immigrant community and establish a fair and humane immigration system. Changes are expected as early as the first day, January 20, 2021, of President-Elect Biden’s administration. Here are some of the changes and policies that immigrants can look forward to: Reinstatement of the DACA program (DACA offers legal status, relief from deportation and work permit to those eligible) Elimination of the Trump public charge rule that disqualified persons from obtaining status for having used welfare or government aid in the past Reversal of harsh and draconian asylum law policies implemented by President Trump including termination of the MPP (remain in Mexico) program. Protection of persons with TPS from being returned to countries that are unsafe Improvement of the naturalization (citizenship) process to make it more accessible to qualified green card holders Work with Congress to try to cause changes in laws that would grant legal status for the over 11 million undocumented persons in the USA, establish an amnesty for agricultural workers, increase the number of allotted family based and victims of violence (e.g. VAWA, U and T) visas. In his roadmap to citizenship for the United States’ undocumented immigrants who have been living in our country for years, Biden has promised to advocate for legislation that creates a clear path to legal status and citizenship for immigrants who register, are up-to-date on their taxes and have passed a background check. It is important for immigrants to take action now and get advice on what documents to collect, how to clean a criminal record and other steps to be ready to apply for immigration benefits when the time comes.
