Trust Amendment v. Restatement One of the features of a revocable living trust is that it is easy to amend. When a trust is created, the person(s) who creates the trust (the grantor) will typically reserve full rights to amend or restate the terms at any time in a writing delivered to the trustee. This power to amend is important because circumstances often change over time. There are a myriad of reasons to update your estate plan and there is no limit on the number of ti...mes you may edit your plan. But, as you make changes, it’s important to consider how those changes might effect the ease of administration of your trust. An amendment will alter specific sections in your trust whereas a Restatement will basically revise your entire trust. You should probably not have over three amendments to your trust as it will make it complicated for your trustee when you pass. At that point, you should consider a Restatement of your trust. Arbitration Agreements in Employee Contracts Remain Legal After Preliminary Injunction Last month reported on AB 51, a new law that made it illegal for employers to include mandatory arbitration agreements in employment contracts. This month, a U.S. District Court judge halted enforcement of this new law, citing that it conflicts with federal law. Employers may continue to require disputes to be resolved by arbitration.
