The San Jose Mercury News recently reported that the State of California and four California district attorneys have sued the operator of 19 California nursing homes where dozens of patients and employees have died of COVID-19. The lawsuit accuses the operator of trading people for profits at every turn. It understaffed its facilities. Its insufficient care led to numerous serious injuries, including pressure sores extending to bone, avoidable amputations, infections, and u...nreported sexual and physical assaults. The lawsuit also accuses the operator of illegally booting residents to free up beds for higher paying new admissions and falsifying information to boost its Medicare ratings. CAL-OSHA fined one of the nursing homes for failing to isolate patients with COVID-19 and failing to make sure employees wore masks or knew how to properly don protective gear. Our law practice is devoted to seeking justice for those injured in long-term care facilities. Bea had a busy and active retirement. She went quad riding, traveled in her motorhome and loved fishing. She was able to take care of all of her own needs. She broke her left arm. It was surgically repaired and she was provided with a splint. She was transferred to a nursing home for rehabilitation with orders to remove the splint, clean her arm, and then re-apply the splint. What should have been short rehabilitation turned in to a long and painful ordeal. Read one of our more upsetting cases.... A locked memory care facility allowed a demented resident to escape. She was hit by a truck and suffered massive injuries. After a long hospitalization and multiple surgeries, she went to a nursing home for rehabilitation and wound care. Her surgeon discovered that the nursing home had provided no care of her foot at all. The bandage change was quite an event in the office with terribly smelling and horrible wholly wounded foot. H...er foot was necrotic, and her toe had exposed bone. Most shockingly, there were maggots in wound. https://jamieson-law.com/dementia-patient-escape/ If you suspect abuse or neglect, contact us now for a free consultation https://jamieson-law.com or call 209-521-1269

According to the National Academy of Science’s Institute of Medicine, preventable medication errors result in more than 7,000 deaths each year in hospitals and tens of thousands more in outpatient facilities. Medical oversight can result in giving the patient wrong medication, a combination of medications, or the wrong dosage. Medical inconsistencies can also be the result of misread medical script, the wrong prescription all together, allergic reactions to the medication t...hey were prescribed, or incorrect charting of the medication by the staff. When you pay a nursing home for the care of your loved one, you expect a high level of care. Nursing home facilities are expected to follow state and federal guidelines. When an elderly resident of a nursing home or a dependent adult receives medical care that falls below the accepted standard of care and suffers serious injuries and fatalities, it is considered negligence. The following are examples of medical negligence at nursing homes: Failure to provide an examination, evaluation, or treatment Failure to provide a test an elderly person might need Delay necessary treatment Provide the wrong treatment Failure to follow up on the medical condition A misdiagnosis or delay in diagnosis Performing unnecessary surgery Prescribing unnecessary or wrong medication I f you suspect abuse or neglect, contact us now for a free consultation https://jamieson-law.com or call 209-521-1269

Residents Rights Month is celebrated in October to honor those living in long-term care facilities and an opportunity to focus awareness on the dignity, respect, and value of each individual resident. It also serves as a reminder to those living in a long-term care facility to learn about and exercise their rights. The Coronavirus (COVID-19) has caused major life disruptions. Restrictions have been imposed on visitation and daily activities, and there is great concern about s...topping the spread of the virus. Elder and vulnerable/dependent adult abuse affects millions of people in the U.S, it occurs regularly in the community and in long term care settings. Research indicates that more than 40% of people over the age of 65 will enter a nursing home before they die. The Centers for Medicare & Medicaid Services (CMS) issued revised guidance on visitation in nursing homes, providing reasonable ways a nursing home can safely facilitate in-person visitation to address the psychosocial needs of residents. The new guidance permits outdoor visitation, indoor visitation, and compassionate care visits and information on how to safely conduct those. At two care facilities in Modesto and one in Turlock, more than 160 residents have tested positive for COVID-19 and some patients have died. The three outbreaks are in addition to cases that generated headlines previously at Turlock Nursing and Rehabilitation Center and the Vintage Faire nursing home and El Rio Memory Care in Modesto. According to data reported to the state, 14 residents recently tested positive at Windsor Post-Acutre Healthcare Center on Evergreen Avenue in ...Modesto and several patients have died. Because of privacy issues, the state has only reported the number of deaths at Windsor is between one and 10. A total of 89 residents at Windsor have tested positive since the virus surfaced in the 175-bed facility. Many of those residents have recovered. More than 30 health care workers have tested positive, according to the state data. Do you have a loved one in a care facility? Early on in the pandemic’s sweep over the U.S., a nursing home resident in Minnesota left her home for a weekend visit elsewhere. When she returned, the facility wouldn’t allow her back inside, for fears surrounding COVID-19. The nursing home demanded a COVID-19 test. But at that point in the outbreak, tests weren’t available. This woman’s story is just one case of the strong correlation between the COVID-19 pandemic and cases of elder abuse and mistreatment. Helping our parents/grandparents feel that they are not a burden is very important. Even the smallest of things make them feel that they are useless and a burden. They are very delicate and vulnerable, so please take care of what you say or how you react. Give them time as they have given everything to you. The more in touch you stay with them the more likely you are to see signs of abuse or neglect.

Health risks for older adults due to isolation increase due to physical distancing orders. Organizations in San Francisco such as Institute on Aging's Friendship Line for people 60 years and older, Meal and Wheels friendly visits, and PACE (Programs of All-Inclusive Care for the Elderly) centers have mobilized to address this issue.
