Peter Holland is no longer an active member of the State Bar of California. He is, therefore, no longer a practicing attorney. If you believe you have legal business with him, you should understand that you do not. Consult an attorney in your local area immediately. He resigned at the conclusion of the lawsuit in which we was involved against Related Management. For a long time now technology has far outrun the legal system's ability to keep up with it. Too many lawyers and judges seem unwilling to understand, much less embrace, technological development. For many, computers are something that happens to staff. When I worked as a judicial intern in law school, the Judge still required the office to use Wordperfect 5.1 for DOS almost a decade after it had become obsolete. Recently, the State Bar of California has taken to giving out t...humb drives with the program materials on it for all of the classes in the annual conference. In one of those classes, half of the lawyers in the room admitted that they did not know what a thumb drive was much less how to work one. The capacity of the Government to track your every movement now is unprecedented in human history. Without robust interpretation of the 4th and 5th Amendments in the light of this technological change, we are in for a future that only George Orwell could have imagined 50 years ago. How can the judicial system keep up with the implications of technological development that it cannot understand? I suspect we need a new privacy law to come out of the legislature if we want to remain free in our own country.
