BREAKING NEWS ON #DACA: Trump has now lost TWICE on his attempt to terminate #DACA. The District Court in New York ruled that Chad Wolf is not lawfully appointe...d to be the head of DHS, and therefore his decision to terminate #DACA is unlawful. This means that: 1) The District Court in New York holds that Chad Wolf was not lawfully appointed as Secretary of DHS 2) That means the gutting of the DACA program by Wolf is invalid. 3) The court certified a nationwide class What does this mean for current #DACA recipients and those eligible to apply? --The memo making DACA renewals only 1 years instead of 2 years is invalid --The memo saying that new applicants cannot apply for DACA is invalid --Advance parole should be restored to 2012 terms What does the class certification mean? It means that the court's order is NOT limited only to the named plaintiffs. Instead, the order applies to all people who are or will be eligible for DACA based on the terms of the program from 2012 (from the Obama Admin). There is one exception: individuals who file their own lawsuits challenging the Wolf memo are excluded from the class certification. So the DACA plaintiffs in the cases in California, are excluded because we have our own case, but this is a sign of things to come. La Corte Federal en California a dado un paro al aumento de tarifas de aplicaciones de inmigración que iba a llevarse acabo a partir del 2 de octubre. Por el momento las tarifas para las aplicaciones seguira sin cambiar. ********** A Federal Court in California enjoined USCIS from the proposed fee increase that is suppose to take effect on October 2. Application fees will remain the same pending further litigation.
