AMAZING WIN for the office today! Obtained a civil judgment for over a half-million dollars ($517,037.50 to be exact) for our client in her sexual assault case against a current Major League Baseball player. Our office has had the case for over two years, and today we were awarded every penny we requested as damages. We do not post names on these updates in order to protect our clients' privacy, but keep your ears open because you just might be hearing more about this in the media... As you can see from the new firm logo, we are revamping the firm's branding in advance of the new website launch this month. Be on the lookout for more regular updates in the future, as well as links to our law blog which should launch toward the beginning of next month.

Criminal trial to begin Monday in Pomona Superior Court with jury selection and likely opening statements as well. Our client is charged with possession and transportation of a controlled substance with intent to sell. We appeared this morning for a trial readiness conference, during which the judge admonished the prosecution for failing to comply with discovery procedures, which we believe will lead to the exclusion of significant evidence against our client at trial. Th...e prosecution is required to turn over to the Defendant copies of all evidence it intends to use against him/her at least 30 days before trial, pursuant to Penal Code section 1054.7. Failing to do so potentially violates Due Process and can lead to the exclusion of evidence or the dismissal of the case. Timeliness in criminal proceedings is a crucial component in considering whether a Defendant's constitutional Due Process rights have been violated, given the accused person's rights to a speedy trial, open disclosure of evidence, right to confront witnesses, and more. It takes careful consideration of the facts of each case to make sure that a Defendant gets his/her fair day in court. We pride ourselves on our ability to aggressively advocate for the Defendant's rights in every case.

Nice confirmation this morning of an earlier win from last month. Appeared this morning in Rancho Cucamonga Superior Court before Hon. Janet Frangie, and obtained a judgment for my clients in the amount of $348,604.42. The judgment confirmed our office's win at an arbitration last month, wherein we sued three individuals and one corporate defendant for contract fraud. The next step, now that we have the judgment, will be to seek out our various enforcement remedies, includi...ng a writ of execution, recording the judgment in the surrounding counties, wage garnishment, and various insurance and tax-related benefits to our clients related to their confirmed loss. Keep a look out for a link to our lawyer's blog coming shortly, in which we will provide an analysis of this case from start to finish, along with other legal insights on our other cases.

Still celebrating the office's win last Friday, wherein we obtained a judgment of $517,000 for our client in her sexual assault case against a current Major League Baseball player. We had another nice win this morning in Pomona Superior Court, obtaining a three-year restraining order on behalf of our client in her domestic violence case. We represented the wife, and after the parties could not reach a settlement through mediation this morning regarding custody and visitation... of their eight year-old, the case was referred to the Department of Children and Family Services (DCFS). We moved forward with the hearing on the domestic violence restraining order, and after the husband admitted to his violent actions and addiction to "huffing" aerosol products, the commissioner granted the 3-year order, prohibiting all contact by the husband if and until the issues of custody and visitation can be properly vetted either through the DCFS or the courts at a later date. It was a bittersweet victory for our client of course, but nonetheless it was a nice result for our side.

BIGGEST WIN in the firm's history today! At binding arbitration this morning in a 2-year case involving breach of contract and fraud, the arbitrator awarded our clients over $280,000 in contract and fraud-related damages, another $60,000+ in prejudgment interest, plus full attorneys fees and litigation costs, bringing the total arbitration award to well over $350,000. The arbitrator also made findings related to fraud as against 3 of the 4 defendants, making them jointly and... severally liable for the full amount. We have made some recent changes at the firm, including moving our primary office to Rancho Cucamonga. We will also be refreshing the firm's website to make it more interactive and streamlined. Keep a look out for even more developments in the future as we re-boot our FB page as well, and will soon be launching a law-related blog. As always, please keep us in mind for any of your legal needs.
