KEEP CALM AND BEWARE OF SCAM! I have received several calls from clients and family concerned about a suspicious phone call from someone claiming to be from the IRS or other government entities. The callers have been known to have a heavy English/Indian accent and will usually demand you to pay an outstanding tax balance. They claim that failure to pay the amount requested will result in the Sheriff being deployed to your home and arresting you! Report these people to the aut...horities so they hopefully can be stopped. Usually the US government will communicate serious matters via US Mail however if you feel the call is legitimate then I would hang up and personally dial the proper government entity to clear the matter and ensure you are speaking to the person in charge of your particular case. To those of you wondering about the difference between a living trust and a will, here is the basic answer. A WILL must be enforced by the probate court, so your family WILL GO to court and WILL PAY court fees; also a will is only valid after one passes away. With a LIVING TRUST your family will NOT go to court and will NOT PAY court fees because a living trust is a legal entity that continues in legal existence after one passes away; also a living trust manages your estate ...during your life. All I own is my home and the bank owns most of it anyway, so there is nothing left over for the probate court to take, however that is a WRONG assumption to make. The probate statutory fees are based on a percentage of the fair market value of your home and NOT the equity. So your home will be subject to fees regardless of the loans you have.
