Cant Afford Chapter 13 Payments After COVID19??? We have received a lot of telephone calls from clients struggling to make their plan payments because of a loss of income during this time. The first thing you should know is that neither our local court system nor Congress has passed any rules yet that help people make their Chapter 13 bankruptcy case payments. Without any special laws in place, what this means is that you are currently required to continue making your plan p...ayments as you always have. I am hoping that the court will issue updated rules soon, but you cannot rely on that possibility at this time. But, if we assume that you have to keep making your plan payments, here are the options available to you: 1. Convert to Chapter 7 if the only reason you are in chapter 13 is because you previously had too high of income to qualify for chapter 7, it may be possible to convert your case from chapter 13 to 7. This could be an unprecedented time to get out of a long term payment plan and into a much more affordable type of case. However, if you have assets (like a lot of home equity) conversion to chapter 7 might not be a possibility. 2. Modify the Plan We do have the option of filing a motion to request a modification of your plan. The court will often approve a reduced plan payment for a period of time until your income improves. Typically, the cheapest monthly payment we can get a court to approve is around $100 per month. To modify your plan, we would have to prove your reduction in income, and it may mean that when your payments go up later, they are even higher than the original plan payment you were making. Exactly how your plan can be modified is specific and individual to each case. If you would like to modify your plan, please call in and set a phone appointment to discuss your case with me so I can give you information that is tailored to your situation. 3. Cancel Your Case You always have a right to cancel your chapter 13 bankruptcy if you cannot afford it. If no payment is affordable to you at all, then it might make sense to cancel your case and refile it in the future when your financial situation improves. To discuss cancellation of the case, we can also have an apportionment to weigh the pros and cons of this action. I hope that the court system will do something to help chapter 13 cases during this crazy time, but so far we are on our own in deciding how to proceed.
