A contract is a legal agreement between two or more parties that establishes obligations for all parties involved. If one party fails to uphold their bargain of the contract, the other parties may be eligible to sue for damages. California Governor Gavin Newsom announced on September 23, 2020 that California will start moving away from reliance on fossil fuels. Executive Order N-79-20 states that by 2035, 100% of all in-state sales of new passenger cars, trucks,drayage trucks, off-road vehicles, and equipment operations will be zero-emission. By 2045, 100% of in-state sales of new medium- and heavy-duty vehicles will be zero-emission. This is not a ban on existing fossil fuel-reliant vehicles. Magistrate Judge Laurel Beeler of the United States District Court for the Northern District of California granted a temporary injunction over the weekend against Executive Order 13943 of Aug. 6, 2020, which addressed potential security concerns with Chinese social media app WeChat (owned by Tencent Holdings). Judge Beeler cited possible First Amendment rights issues, as well as the fact that WeChat is the primary means of communication for the Chinese community. The US gover...nment could appeal to the Ninth Circuit to seek to overturn the injunction, but for now WeChat will continue to appear in app stores. Supreme Court Justice Ruth Bader Ginsburg passed away yesterday after suffering from complications related to metastatic pancreas cancer. She was a pioneer in equality and justice, and will be sorely missed. Ginsburg wished to be remembered as "[s]omeone who used whatever talent she had to do her work to the very best of her ability. And to help repair tears in her society, to make things a little better through the use of whatever ability she has. To do something, as [her] c...olleague David Scouter would say, outside [herself]. Yesterday, California Governor Gavin Newsom signed two new COVID-19-related laws into effect. AB 685 states that within 1 business day of being informed about a potential COVID-19 exposure in the workplace, an employer must take four steps. These steps include providing written notice to all employees of the potential exposure, as well as what disinfection and safety plan will be implemented. ABA Journal reported yesterday that a group of California law school deans have asked the California Supreme Court to change its upcoming October bar exam to an open-book format with no remote proctoring. The October 2020 bar exam was already going to be administered online, but was supposed to use remote proctors to ensure nobody would cheat. The deans cited a number of reasons behind the request for the change, including the COVID-19 pandemic, California wildfires, housing issues, and racism. Yesterday, California Governor Gavin Newsom signed Executive Order N-83-20 into effect. This Order allows CA citizens who are 70 years of age or older to renew their drivers licenses by mail instead of going in person to the DMV where the risk of contracting COVID-19 is greater. The Order will stay in effect until June 30, 2021, or until the CA State of Emergency is terminated, whichever occurs sooner. A class-action federal lawsuit filed in California in 2018 against college admissions testing company ACT Inc. has reached a settlement agreement. The lawsuit alleged that ACT violated the Americans With Disabilities Act (ADA) and California's Unruh Civil Rights Act by informing colleges which students had received special testing accommodations or had otherwise indicated they had a disability. Yesterday California Governor Gavin Newsom signed Executive Order N-82-80 into effect. The Executive Order outlines the ways the CA government hopes to combat climate change and enact climate-protecting protocols. By October 2021, various CA agencies will have worked together to develop a Natural and Working Lands Climate Smart Strategy. This Strategy will work on improving air quality, clean water supplies, and economic sustainability. By February 1, 2022, the California Nat...ural Resources Agency and other such state agencies will work together to protect and restore biodiversity, safeguard CA's economic sustainability and food security, build climate resilience, and expand equitable outdoor access and recreation for all CA residents. By 2030, the goal is to have conserved at least 30% of CA's land and coastal waters.
