The Supreme Court decision on DACA from last week ais a big relief for those that already have DACA. Unfortunately there is no news yet on when new DACA applications can be filed. Most attorneys believe that under the Supreme Court decision, USCIS should begin accepting applications for new DACA applicants immediately. However they have not provided any information about when they will begin accepting those applications and with this administration we have to assume they will... do everything possible to delay or make it difficult. At this time I am not starting to prepare applications for new DACA applicants until we have more information. I know some other attorneys are doing so I encourage people who to seek a second opinion from another attorney if they would like to try to file an application sooner. My recommendation is to start finding and saving the documents you will need so that you have them ready to file as soon as possible if they begin accepting new applications. This would be proof that you were in the US before June 15, 2007, school transcripts showing your graduation, and documents for every 2-3 months from the time of your graduation to the present day (paystubs, bank statements, etc.).

Hi clients. Please contact me if you have any questions or are nervous about the executive order freezing immigration. The good news it that it does not apply to most of my clients. People applying within the US are not included in the freeze. Spouses and children of US citizens are not included in the freeze. The bad news is that it does apply to spouses and children of permanent residents who will need to apply for their visa at a consulate abroad. The initial order is only for 60 days and consulates are currently closed so at first it will not change anything. But most people expect that the order will continue to be extended at least through the election and longer if he is reelected. I am trying to reach out to clients who will be impacted by the order, but don't wait to contact me if you have any concerns.

I have been getting lots of questions about stimulus payments. You will likely receive a stimulus payment as long as everybody on the most recent tax filing has a social security number. If you do receive the payment, then it is perfectly fine to save, spend it, or use it how you would like. There are no immigration consequences for receiving or using the stimulus payment. Unfortunately, if somebody in your tax filing has an ITIN number because they do not yet have a social s...ecurity number, then you will not receive any stimulus payment. This is extremely unfair for US citizens married to an undocumented spouse and for US citizen children with an undocumented parent who also need help during these difficult times, especially as that is the same group of people who will not qualify for unemployment. California has indicated they will attempt to make similar stimulus payments of $500 to undocumented individuals, but we are still waiting on details. See more

Receiving unemployment insurance will not harm your case in any way. Unemployment insurance is an "earned benefit" that you have earned with your paychecks. The agency IMPORTA Is offering free DACA renewals by appointment at their offices in Santa Maria and Lompoc. They are also able to pay the $495 filing fee for some applicants. I recommend that anybody who has DACA expiring in all of 2020 renew their DACA as soon as possible, no later than the end of February if possible. Even my current clients should consider renewing with IMPORTA to save costs. I am happy to provide copies of any of your prior applications or paperwork if it would help.
