#KLQuestion: Can a consultant request a company to sign a NDA? -->#KLTip #2: YES, YES, YES! Nothing is stopping a consultant from doing this, although it’s unusual for he/she to bring it up. Instead, there’s a good chance the hiring company will request the signing of a NDA the first day. In that case, make sure the agreement signed is a bilateral NDA. A bilateral NDA is a contract where BOTH parties agree to keep information exchanged between them a confidential. Many attorneys advise on a mutual NDA in all cases to consequently draft the provisions to be fair and equal for both sides in the event that the information receiving party later becomes a disclosing party.
