Congress has passed a $900 billion stimulus bill that will provide direct payments and additional unemployment benefits to struggling Americans and badly needed funds for housing providers and small businesses, including REALTORS. President Trump is expected to sign the b...ill shortly. C.A.R. has advocated for many of the provisions that would provide meaningful relief to REALTORS including extensions of Pandemic Unemployment Assistance (PUA) benefits and additional forgivable Paycheck Protection Program (PPP) loans. The law will also provide direct payments of $600 to Americans and rental assistance. Specifically, the law will: Unemployment Benefits and Direct Payments Allow an individual to receive unemployment benefits (traditional or PUA) for up to 50 weeks, through March 13, 2021, in California. Provide an additional $300 a week in federal unemployment benefits for individuals receiving PUA or traditional unemployment compensation for 11 weeks, beginning December 27, 2020, and ending March 13, 2021, in California. Provide a one-time direct payment of $600 for individuals making up to $75,000 and $1,200 for couples making up to $150,000, as well as an extra $600 per eligible child dependent. Payments are expected to begin rolling out before the end of the year but will take time to get to all eligible recipients. Paycheck Protection Program (PPP) Provide an additional $284 billion for PPP loans. Allow certain eligible businesses to receive a second PPP loan of up to $2 million. To qualify for a PPP second draw, businesses, independent contractors and other self-employed persons must have 300 or fewer employees, have used or will use the full amount of their first PPP loan, and be able to demonstrate at least a 25 percent reduction in gross receipts in any quarter of 2020 compared to the same quarter in 2019. Create a simplified forgiveness process for PPP loans up to $150,000. Allow use of PPP funds to cover purchase of Personal Protective Equipment (PPE) for employees and certain other expenses not eligible for the first round of PPP loans. Eviction Moratorium & Rental Assistance Provide $25 billion to states and local governments for rental assistance. Allow landlord to directly apply for the funds. Extend the CDC's eviction moratorium through January 31, 2021. California’s eviction moratorium already extends through January 31, 2021, so REALTORS should see little effect from this provision.

At least here in Solano County, the Board of Supervisors awarded some Federal CARES money as direct landlord payments for struggling County tenants administered through a local charity. Biden Likely to Continue Eviction Moratorium: As President-elect Joe Biden prepares to enter the White House, he and his administration are weighing a number of economic measures to take in the initial days and weeks. Among these, according to a report in the New York Times, is an extension on... the moratoriums on evictions and foreclosures. This should not come as a surprise to observers. The US economy is showing signs of strain as Covid-19 infections surge. The Biden Administration is reportedly bracing for a double-dip recession as states put in place more restrictions. While there is reason to expect that the rollout of a vaccine will revive the economy next year, the short-term is likely to be rocky. Lifting the moratorium would send struggling renters behind on their bills into the streets. The eviction moratorium was put into place in September by the Centers for Disease Control and Prevention, which used its quarantine authority to keep COVID-19 from spreading. The order is due to expire on Dec. 31, 2020 but can be extended. The move was an unprecedented use of executive authority, and has been challenged by landlords and other parties. One suit argues that federal agencies do not have powers to waive state laws and the CDC has encroached on private property rights with no legal authority. There has been pushback against statewide eviction moratoriums as well. This month, for example, landlords in Washington state filed a federal lawsuit against Governor Inslee over his statewide eviction moratorium. As a result of the moratoriums, evictions are expected to be low this year, according to Jay Parsons, RealPage’s deputy chief economist and vice president of asset optimization. But there are many other factors besides the moratoriums that have kept these numbers down, he argues, including sympathetic property owners working overtime to accommodate distressed renters, and backed-up court systems. Right now, property owners are taking on much of the burden, Parsons writes. But that’s unsustainable, adding more risk for an already fragile U.S. economy. Proposition 19, Property Tax Portability, Passes California voters have spoken and over 8.2 million voters supported Proposition 19. Passage of Proposition 19 is a win for all Californians providing additional funding to firefighters, local governments, and school districts, as well as limiting property tax increases for some of California’s most vulnerable communities. In other news, Proposition 21 has officially lost with nearly 60% of voters rejecting rent control. As of... November 10th, the Associated Press reported that Proposition 15 had also failed, with 48.2% voting yes and 51.8% voting no. We continue to face big challenges as a state, but with passage of Proposition 19, we will be able to address some of those challenges by providing housing relief for homeowners, seniors and vulnerable populations while also generating billions in revenue for schools, state, and local government. With this victory, California will be able to recover and emerge stronger than ever.
