I just sent this to my CA legislators, please contact them this week in support of amending AB 1850 to include professional translators and interpreters. As a language service company owner in California, I am writing in support of amending SB1850 to include an exemption for professional linguists. The currently proposed exemption for certified linguists is not sufficient since there are not enough certifying bodies in all languages and that is not the main thing that identi...fies freelance linguists in California as independent contractors. The fact that as employees they would not be able to work for my competition stands out as a big one. That they set their own schedule and policies is another. It is also important to note that the EDD has lost the majority of cases trying to classify linguists as employees since 2018 when they had targeted our industry. Interpreting and translation can be done as both employees and independent contractors and we would like an exemption from AB5 so that the linguists themselves can choose how they would like to work if they find themselves in a relationship that could be set up as employment. The way 90% of language service companies contract is more conducive as independent contractors and presents many difficulties when trying to make them employees. AB5 is detrimental to our business, to our contractor’s businesses and ultimately to California. Please include an exemption for linguists who want to be independent contractors to be allowed to choose this option. There is some potentially great news from the California Legislature with the new Bill SB900 which is needed to exempt interpreters who wish to remain independent contractors. Please write the legislators if you agree that interpreters should be able to choose to be independent and keep interpreting business in California. This is especially important with the SIP situation where no face-to-face work is even being contemplated.
