Eventually SCOTUS will have to deal with right of privacy in hospitals and hospital rooms. there's not much case law out there but we see these searches in DUIs fairly often as cops try to overhear conversations that they don't have access to otherwise. Right now ther is a slight distinction between private rooms and other rooms including emergency treatment rooms.
Bias is sometimes reliant on who signs the check, eh.

Former Assistant District Attorney has been fired after Jeff Adachi, San Francisco Public Defender, filed a complaint with the California State Bar and called f...or a criminal investigation into "unethical behavior". "Adachi said Mains withheld potentially exculpatory DNA evidence from the public defender’s office in two cases, and in two other cases didn’t turn over other forms of evidence, including police body-camera footage and witness interviews."
The judges just accept the presumptive test as valid in spite of stories like this.
