DACA ORDERED RESTORED. The U.S. District Court for the District of Maryland issued an order in Casa de Maryland v. Dept. of Homeland Security on July 17, 2020, restoring DACA to its pre-rescission status. This decision goes beyond the Supreme Court’s June 18 determination that the DACA rescission was unlawful; it explicitly enjoins the Department of Homeland Security, or DHS, from implementing or enforcing the rescission. In light of these rulings, U.S. Citizenship and Immigration Services, or USCIS, should accept initial DACA applications from those who have never held DACA as well as requests for advance parole. At this time, USCIS has yet to issue guidance or confirm that it will process such filings in compliance with these court decisions.
