Prenups should protect BOTH spouses. In fact, for a prenup to be enforceable in court, the agreement must: be fair not completely favor one person over the other... be signed by both partners with their lawyers present have each person honestly share and discuss their assets and debts Be reasonable with the terms from the outset, so the agreement will be duly enforced by the courts in the event of a divorce. By building in a sensible support structure for your spouse in the premarital agreement, you have complete control over the terms and avoid leaving it up to the courts to decide how assets and liabilities get distributed. Prenups are designed to support both spouses equally with a mutual agreement on financial decisions both during and after marriage.
