Friends: I write to seek your assistance. As most of you know, I am a lawyer who litigates cases on behalf of models when companies unlawfully use their images. We have litigated on behalf of at least 100 models over the years as this unlawful conduct is unfortunately extremely common. We now have the honor of presenting multiple issues that are crucially important to the modeling and entertainment communities to the California Supreme Court. One of the forms of damages avail...able to a model whose image rights are violated is that the offending company must disgorge any profits made from the unlawful use of the model’s image. We must convince the Supreme Court to fashion a rule that allows recovery of profits by placing the burden of disentangling revenue generated from factors other than the model’s image on the defendant company. We also are asking the Supreme Court to recognize that when a model brings a lawsuit against a company, forces the take-down of the unlawful use of the images (crucially important to every model) and is awarded well over $1,000,000 from a jury, that the model won the lawsuit.
