Fast forward to 1:50:00 to hear yesterday’s oral arguments on the appeal of the preliminary injunction which actively prohibits the enforcement on AB 5 on truckers. AB 5 is a direct attack on the trucking industry. The State failed to provide clear examples showing under which circumstances owner operators could continue to work as independent contractors instead of employees of the hiring entity’s business. The California Trucking Association emphasized that AB 5, through it...s prohibitions on motor carriers to contract with owner operators, bars entry into the industry noting that the principle way small entrepreneurs enter the motor carrier industry is as owner operators. They start out as owner operators. Today the Ninth Circuit Court of Appeals will hear oral arguments from the California Trucking Association (CTA) and the State on the State's appeal of CTA's preliminary injunction actively prohibiting the enforcement of AB 5 on truckers. The hearing will determine whether the injunction remains in place. It could take up to three months to receive a ruling on the matter; however, during that time, the injunction actively prohibits enforcement of AB 5. Following the ruling on... the injunction, CTA will return to the district court to continue arguing that Federal law (specifically the FAAAA) preempts State attempts to regulate a motor carrier's rates, routes or services (like AB 5).
