Big news from federal court. A client came to me because his prior attorney wanted him to accept a 37-month prison offer on a drug conspiracy case. Once I took the case over, I immediately noticed something didn’t add up. You hear about entrapment on TV and in the movies, but it is not a defense we ever see work in the real world. What my firm’s investigation turned up ended up getting the entire case dismissed because my client was set up by a confidential informant (CI). Th...e CI is engaged to a guy I will call John Doe. John happens to be a drug dealer but somehow, he never gets arrested (hmmm, I wonder if it’s because his fiancé is a CI??). The CI calls my client and says her friend (an undercover special agent) wants to buy some drugs. My client asks the CI why she just doesn’t call her fiancé/ drug dealer. CI says she can’t get the drugs from John because he will get mad at her for hanging out with her ex. Being the nice guy that my client is, he reluctantly agrees to help. The CI has my client go to John’s house and pick up drugs from John to sell to the CI’s friend aka undercover agent. Phone records backed all this up. My client shows up to CI’s house and she is with the undercover agent who is wearing audio/video equipment. My client hands the drugs from John over to the agent and then leaves. A state and federal task force then surveille my client for eight months and find nothing because he isn’t a drug dealer. Eight months after the set up he gets indicted in federal court. Full credit to the prosecutor on this one- once I convinced him what actually took place he was just as offended as I was.he did the right thing and dismissed the case before trial.

A few big wins to report! A decorated combat Marine was arrested after he took a left turn in front of a motorcycle on a busy street where a tree in the median obscured traffic coming the other way at night. The motorcyclist was tragically paralyzed from the neck down as a result of the collision. My client panicked and fled the scene. His blood results came back with high amounts of THC, as well as trace amounts of xanex and his BAC was .05%. He was charged with multiple fel...onies and faced 15 years in prison if convicted. He fired his original attorney and hired me for trial. A few years prior, the client’s Humvee was hit with an IED in Afghanistan and he had to drag his mortally wounded friend out of the vehicle and watch him die. This resulted in severe PTSD. The VA prescribed every prescription drug under the sun but they made him feel like a zombie. Marijuana was the only drug that made him feel normal again- he obtained a marijuana prescription and smoked 5-6 times a day. We were able to convince the jury that daily smokers of marijuana do not feel the impairing effects that a casual smoker demonstrates. We were also able to convince the jury that the motorcycle hitting his car was similar to the IED hitting his Humvee in Afghanistan and that the motorcycle collision caused a PTSD flashback. After a very emotional 8-day trial the jury came back with a not guilty verdict (10/2) and the judge dismissed the case. This was a case with no winners but certainly happy for my client. Another client was having suicidal thoughts and shot out his sliding glass door at a condo complex. He was arrested and charged with a felony that if convicted would have resulted in the loss of his job. We finished up trial last week and the jury came back with a not guilty verdict. We were able to convince the jury that the DA did not prove beyond a reasonable doubt that the shot was intentional. Aaaand finally- outrage of the month. A client was at a concert were a brawl broke out. The client took no part in the fight and none of the witnesses picked him out of a lineup. Nevertheless, the DA decided to flip his life upside down and arrest him for felony robbery and assault. They made this charging decision even though we presented evidence before he was charged that he took no part in the fight. Once the case was filed and we were in court, I was able to show a different DA pictures and videos from the night that clearly showed my client taking no part in the fight. The case was dismissed this morning at a preliminary hearing. My client is still out the thousands of dollars for bail/ legal costs and will never get the days spent in jail back.
