The Department of Justice has issued a directive to EOIR, "immigration courts" aimed at speeding up removal proceedings by having courts dismiss previously scheduled master calendar hearings for those individuals with representation and instead set an individual hearing date with orders to present applications for relief and evidence with a specific date, containing at least 45 days notice.

DACA is back entirely. USCIS must now accept INITIAL applications again. The court has ordered the government to post public notice about this welcome change within 3 days and submit a report regarding the DACA program by January 4th 2021.

Beginning December 1st, naturalization applicants must study 128 questions for our citizenship exam instead of 100. Applicants must also answer 12 out of 20 questions correctly instead of 6 out of 10.

The Ninth Circuit has ruled that TPS must end. An appeal to the US Supreme Court is expected. Currently TPS expires January 4th 2021. If the appeal process is not successful, TPS recipients will probably be given a six month window to change status or depart the US.

Consular officers already have the right to deny a pregnant woman a visa. I believe the purpose of this new rule is to symbolize this administration’s renewed effort to end birthright citizenship. DHS Deputy Cuccinelli was incorrect in his statement to the press when he said I do not believe you need an amendment to the Constitution while discussing birthright citizenship. I’m surprised to hear Mr Cuccinelli who is a lawyer ponder aloud, I think the question is do you need congressional action or can the executive act on their own. The idea of ending birthright citizenship which is guaranteed under the 14th Amendment of the US Constitution by Executive Order is extremely ignorant Of Constitutional surpremacy.
