As 2020 came to an end, the federal government passed the Coronavirus Response and Relief Supplemental Appropriations Act, which extended the time for which employers may obtain payroll tax credits for leave provided consistent with the federal Families First Coronavirus Response Act (FFCRA) through March 31, 2021 but did not extend the obligation to provide such leave. On November 30, the OAL adopted Cal/OSHA's extensive emergency temporary standards regarding COVID-19. The temporary standards, effective immediately, apply to all employees and places of employment with the exception of places of employment with one employee who does not have contact with others, employees working from home, and employees covered by Cal/OSHA’s Aerosol Transmissible Diseases standard. Heading into Thanksgiving, we are thankful that Leadership Sacramento didn’t let a pandemic stand in the way of their annual tradition of supporting the community. Leadership Sacramento has been in existence for 35 years! The program always ends the year by completing a major community project. The Leadership Sacramento Class of 2020, of which our own Kaitlyn Saberin is a member, selected the Sacramento Regional Conservation Corps (SRCC) as its partner, and the group spent s...everal months working on a landscaping and gardening project. In spite of the pandemic, the great news is that work on the SRCC projects continued ON SCHEDULE since back in April, and funds raised beyond the cost of the initial projects will be provided to SRCC to support the organization. The continuing evolution of California law governing the classification of workers as employees or independent contractors took another confusing step on September 4, 2020, with Gov. Newsom’s signature of AB 2257, a revision and recast of 2019’s well-known AB 5. The new bill creates a host of exceptions to the ABC test first adopted in California by the State Supreme Court in the Dynamex decision and then significantly broadened to most all California workers by the Legislature in AB 5. The law was drafted as an urgency statute and went into effect immediately upon the Governor’s signature. This year, California’s statewide minimum wage rate increased to $13.00 per hour for employers with 26 or more employees and $12.00 per hour for employers with 25 or fewer employees. At the same time, several municipalities increased their minimum wage rates above the state minimum, with minimum wage rates as high as $16.05 in some localities. Effective July 1, 2020, several other cities and counties will increase their minimum wage rates above the state minimum wage. The City of Sacramento has established a Small Business Recovery Program with a portion of the funds received from the federal CARES Act.
