What is Pre-Court Intervention? Using the criminal defense process successfully to have criminal charges against a client dropped completely, or reduced in severity, before a case proceeds to court with formal charges at arraignment. Advocacy: The Pre-Court defense includes our firm's private investigator working to uncover helpful evidence the police missed. Our lawyers prepare a formal written legal position to law enforcement and the prosecuting agency, to highlight issues... of proof, i.e. factual weaknesses in the prosecution’s case should the matter proceed to trial, as well as mitigating and equitable arguments. A conference is sought to advocate the defense position. Discretion: An effective intervention position is geared at persuading the prosecutor who makes the ultimate charging decision to find that reasonable doubt is present based on all evidence in the case. Charges Not Filed: The most common areas for pre-filing intervention are domestic violence, white-collar, and sex crime accusations. We regularly secure "rejects" for firm clients. Takeaway: An arrest seems like the end of the world. Timely intervention may cause the entire incident to effectively disappear: the clients' record remains clean and the arrest is deemed a "detention only," per Penal Code 849.5

The courts have responded to the pandemic in certain cases. Following COVID court procedures for pre-trial release, and the prosecutors' review of my firm's presentation of mitigating evidence, we secured the release of in-custody defendants whose bail set at over $1,000,000 each: 1. Client facing felony vandalism counts released into a mental health facility after months in custody. The goal is to pay full restitution before the next court date. Importantly the client is out... of jail receiving treatment. 2. Client charged in a conspiracy involving illegal conduct in "casitas" (allegedly gang-controlled party houses). The court, at the defense's request, ordered his release with permission to travel out-of-state to shelter in place with his family in Texas. The evidence showed client has a minimal role and no prior criminal record, and the DA's office stipulated to the release. 3. Client accused of vandalism in a place of worship, had been in custody for months. Our firm convinced the prosecutor to look at the case closely based on our presentation of mental health evidence. Despite an initial position that the accuser committed a hate crime, the prosecution stipulated to the release.
