CASE ALERT: Wells Fargo v. Mahogany Meadows - Wells Fargo Bank brought a quiet title action against an owner who acquired title at foreclosure auction, a homeowners association, and the association’s agent, asserting that a Nevada statute that gives a superpriority lien to homeowners associations for unpaid assessments on properties within an association violates the Takings Clause and the Due Process Clause. The district court dismissed Wells Fargo’s action for failure to s...tate a claim, and the 9th Circuit Court of Appeals upheld the ruling, holding that Wells Fargo cannot establish an uncompensated taking, because the enactment of section 116.3116 predated the creation of Wells Fargo's lien on the property and applies prospectively against liens created thereafter, and the Due Process Clause was not violated, because Wells Fargo did not dispute it received actual notice of the foreclosure action. #TakingsClause https://cdn.ca9.uscourts.gov//opin/2020/11/05/18-17320.pdf See more

Intellectual property is the lifeblood of the video game industry, and a proactive IP strategy is needed to secure appropriate IP rights. The law and lawyers have been challenged to keep up with the fast-paced, evolving world of video games. This webinar will offer practical tips for handling and advising on IP issues that arise for video game developers. Panel speakers are Deborah Davis Han and Kimberly Culp. Deborah Davis Han is an intellectual property and advertising attorney who has devoted much of her career to the video game industry.
