Inglewood City Council takes steps towards a permanent rent control ordinance By Danielle Leidner-Peretz Since March 5, 2019, rental housing providers in the City of Inglewood have been temporarily barred from raising rents by more than 5 percent (5%) and from evicting renters under an emergency rent control ordinance unanimously adopted by the City Council. On April 16th, the rent freeze was extended for 60 days, until June 18th, as the City Council contemplates adoption of ...a permanent rent control ordinance. While the City Council appears to recognize the need to balance maintaining housing affordability without penalizing mom and pop rental housing providers, the recommended ordinance proposal of rent control, just cause eviction and relocation fees tips the scales primarily to one side, the renter. The proposal exempts single family residences and rental properties of four units or less. City Council is contemplating implementing an ordinance including the following: Rent cap: eight percent (8%) within a single 12-month period with a limit of one rental increase, regardless of the amount, within that period; Relocation fees: triggered by a rental increase exceeding four percent (4%) for renters who have lived in the unit for nine months or more. Any renter who is served a 60 day no cause termination notice would be eligible for relocation assistance. Relocation fees would be calculated based on approximately 5 times the average monthly rent in the Los Angeles area for a comparable unit. The relocation fee range would be from $7,700 for a studio to $14,600 for a 3 bedroom. Enhanced relocations fees would be provided to seniors, disabled, households with minors and longer term tenancies. Just Cause Eviction: this would require a property owner seeking to evict a renter, to provide the specific reason for the eviction that falls within the list of permissible reasons, such as non-payment of rent or used the premises for an unlawful purpose and evidence to support the eviction based on the reason set forth. The proposed ordinance includes the ability for rental housing providers who have owned the property for over 7 years to appeal the rent cap through a showing of their net operating income that they are not receiving a fair return. The proposed ordinance under consideration would effectively limit rental housing providers to providing a four percent (4%) annual rent increase or be subject to paying exorbitant relocation fees. The just cause eviction provisions would also make it difficult to evict problematic renters who are destroying property or engaging in illegal activity and creating conditions that negatively affect all the good renters in the building.
