New California Landlord Law for resolving Evictions: AB 2343 unlawful detainer. Existing law establishes a procedure, known as an unlawful detainer action, that a landlord must follow in order to evict a tenant. Existing law provides that a tenant is subject to such an action if the tenant continues to possess the property without permission of the landlord in specified circumstances, including when the tenant has violated the lease (i.e. not paying rent) by defaulting on ren...t or failing to perform a duty(creating a hazard on the property) under the lease, but the landlord must first give the tenant a 3-day notice to cure the violation or vacate. This bill would change the notice period to exclude judicial holidays, including Saturday and Sunday(this is very important since you could run afoul of the new law and fall into a "wrongful eviction" trap. Under existing law, a plaintiff or owner, that wishes to bring an action to obtain possession of real property must file a complaint and serve the defendant--tenant, with a notice of summons, in which case the defendant has 5 days to respond. This bill would clarify that the period in which a defendant may respond to a notice of summons does not include judicial holidays, including Saturday and Sunday. This bill would provide that these provisions would become operative on September 1, 2019. New Landlord Property Law for California 2019 Unlawful Detainers and Evictions: AB 2343 UD Notice and Answer = Tenants are given more time to respond to resolve evictions. Under current law the owner must give the tenant for breach of lease or Unlawful Detainer three calendar days of notice to pay or resolve the violation. ... After the UD has been filed with the court and the summons and complaint has been served to the tenant, the tenant has five calendar days, the notices and grace period in the past always included the weekends or holidays. Not anymore, Effective 9/1/2019, AB2343 the 3 Day Calendar Day and 5 Calendar Day answer period will be calculated excluding weekends and holidays. Failure to comply could result in "wrongful eviction", delay on your UD filing and of course loss of your rental income.
