Helped a client held wrongfully in jail for a week go free!

Obtained a stay of a license suspension in superior court today for a client that had license suspended one year for allegedly refusing to give a breath test. This procedure can be undertaken when losing a DMV hearing by filing a writ to obtain an Order from the judge directing the DMV to reinstate a license. Victory!

After a two day hearing, where the government brought in five witnesses to testify, we were able to obtain a Ruling in our client's favor, throwing out all evidence obtained as a result of the officers violating his Constitutional Rights! Our client faced a month of jail, two years drivers license suspension with no restrictions available, as well as many other fines and penalties. The DUI will have to be dismissed.

After a year of defending a case where our client was wrongfully arrested for DUI, we built a strong defense and took the matter to trial. The prosecutor then dismissed all three counts of DUI !!!

After a hearing regarding the revocation of our client's driver's license, the hearing officer issued a Decision to reinstate the license.

Can Police search through your cell phone if you are arrested? In a new case, Riley v. CA, The U.S. Supreme Court Ruled police cannot search your cellphone without a search warrant. In order to get a warrant police will need to describe to a magistrate particular evidence they intend to find. Police also need a warrant to draw blood from a DUI suspect who refuses to give a breath or blood test. If there was no warrant the blood can be excluded in Court. This cripples the... prosecution's case as they bear the burden of showing a suspect was under the influence.
