Real Question of the Day from an online consult: I have a son with a learning disability and is a senior in high school. Can I file for child support? In addition my ex is order to pay alimony until either party dies or I remarry and he is constantly late. I have advanced melanoma so I really need his payments on time so I can pay my medical bills for treatment. Can I file a contempt on the alimony? Our Answer:... You can file for child support, but you may not win. The actual standard is that your child must not be capable of supporting himself. A learning disability in general will not usually meet the test for adult child support. As for the alimony, a wage garnishment with an arrears order from the court may be better than contempt unless he actually has the funds to satisfy his arrears in full. Contempt is a costly and complicated criminal proceeding that definitely requires an attorney in my opinion. If you can get relief by other means as noted, I would do that first, as contempt may not get you the relief you actually need.
