Taking Full Advantage of the Maximum Step Up in Tax Basis Saul Klein The following is from the Manuscript I wrote for my real estate and financial planning clients:... 1. What is a Trust? A Trust is a separate legal entity (like a corporation or a partnership) that holds, administers and distributes one's property. The administrator is called the "trustee". The person(s) receiving the benefits of the Trust are called "beneficiaries". The person who establishes the Trust is called the "trustor", "grantor", "settlor", "donor" or "creator". The trust is created by a written agreement between the creator and the administrator. 2. What is a "Living" Trust? A trust created while one is alive. It begins its activities immediately after its creation. 3. What is a 'Testamentary" Trust? A trust created by one's Will. Operational at the end of probate. It requires the administration of all of one's assets. 4.What is the difference between a "Revocable" and Irrevocable" Trust? Both are created while you are living. The "Revocable" trust can be changed at any time until a designated event occurs (usually one's death). An "Irrevocable" trust cannot be changed once it has been created or made irrevocable. 5. Why should I create a Living Trust? A Living Trust provides the following benefits: A. Opportunity to save estate taxes. B. Avoidance of probate proceedings. C. Opportunity to delay the transfer of assets until specified ages have been attained by the beneficiaries. D. Provide independently for grandchildren with delayed transfer of assets until they attain specified ages. E. Provide full management of one's assets while one is living. F. Privacy of one's personal affairs. G. Ability to provide immediate distribution of income to the beneficiaries after one's death and to continue the operations of the trust without undesirable delays. See more
