On September 1, 2020, the CDC issued an order titled Temporary Halt in Evictions to Prevent the Further Spread of COVID-19. The CDC Order establishes a national moratorium on certain residential evictions between September 4, 2020 and January 31, 2021. There are 5 categories of evictions that are excluded from coverage under the Order. These evictions may proceed against otherwise covered persons during the Order’s effective period: 1) Engaging in criminal activity on the ...premises. 2) Threatening the health and safety of other residents. 3) Damaging or posing an immediate and significant risk of damage to the property. 4) Violating any applicable building code, health ordinance, or similar regulation related to health and safety. 5) Violating any other contractual obligations, other than the timely payment of rent or similar housing-related payment, which includes nonpayment or late payment of fees, penalties, or interest. #Evictions #CDC #attorney #lawfirm #landlord #tenants #professional

In that case, tenants should submit a declaration of COVID-19 related financial distress to their landlords every month and specify that they cannot pay for the reasons stated in the declaration.
