Competing Sisters! A new probate client, "L," had been a loyal daughter to her dad for many years, especially during the last few years of dad's ill-stricken years. On the day that dad was to execute a will and a grant deed to put L on the title, he passed away, thereby leaving his estate intestate (i.e., without a will). An estranged daughter of dad's filed for probate petition to become the Administrator of the estate, and this daughter had not even showed up at dad's funer...al. My client, L, filed for a competing probate petition to become the Administrator as well. Now the judge would need to decide who's better suited. The point here is that the California intestate succession code will take over this case -- and you can guess the rest in that it's not going to be a happy ending for L. Dad's estate assets will be passed onto L and 3 other daughters who were all estranged from him and hadn't spoken to him in years, as per the code that does not mention "loyalty." My client L hasn't accepted this fact as yet. So sad!! See more
