How do I make sure my kids get my money/property when I die? That’s a question we get on a daily basis. Here are your options (with their pitfalls), and our own recommendation:... Option 1: You could do nothing. Pitfall: This is risky because you have no control. The property will have to go through probate (a process where a judge will control the timing and manner of all your distributions). Option 2: You could leave the money directly to your kids. Pitfall: Although this does ensure your kids get money, it does create problems. For instance, if your kids are under 18, they won’t be able to inherit until they are of age. In the meantime, the judge will appoint a guardian to look after those assets until that time. The cost for this will be out of the money you are leaving for the kids. Not to mention, you will have no control over how the funds are used both before you child turns 18 or after. Neither of those options are sounding top-notch, are they? Here’s what we recommend : Leave your assets in a trust for your kids. You won’t have to worry about the age of your kids AND you get to pick who will distribute your funds to the kids. That person is called a trustee. Plus, you avoid the probate process altogether AND you get to choose when people receive your property and for what purpose. Want to learn more about trusts? Please share with anyone who you feel might need it, or is going through the grieving process right now. At the time of death: Contact the police Contact all known friends and family (if your spouse was in the military, contact The American Red Cross) Contact their employer if necessary Find their final instructions (did they have a burial plan?) Within 5 days of death: Prepare for burial/funeral/memorial service Contact their estate planning attorney, if they had one Delegate tasks (ask close friends and relatives to answer the phone, collect their mail, care for the pets, etc.) Within 15 days of death: Order death certificates Contact the rest of the essential contacts (contact life insurance to locate life insurance policies, contact tax preparer to determine the filing of final income tax, cell phone company to cancel subscription, etc.) Read the Will, Trust or other estate plan documents Within 30 days of death: If you haven’t by now, hire an estate planning attorney to help you through this confusing process. New PAID Sick Leave and Family Medical Leave Law The Families First Coronavirus Response Act has been signed into law. This bill addresses many Coronavirus issues - one being PAID family leave and sick leave. This bill applies to ALL employers with 500 or less employees. Small and midsize companies are required to provide two weeks of paid sick leave (at 100% of the person's normal salary up to $511 per day) and up to 12 weeks of paid family and medical leave (at 67% of th...e person’s normal pay, up to $200 per day) for employees affected by the coronavirus who have worked at the company for at least a month. By the way - an employee will qualify for family and medical leave if they need to care for a child whose school or child-care facility is closed due to the virus. Many small-business owners are worried about how to pay for these benefits, especially at a time when business across numerous industries has basically come to a halt. The bill provides a tax credit to cover the costs. The credit is applied to the tax the company or nonprofit normally pays for each employee’s Social Security. (This is the 6.2 percent tax employers pay on each employee’s salary.) If sick leave or family and medical leave ends up costing more than the Social Security bill, the U.S. government will send the employer a check to cover the remaining costs. The labor department can exempt employers with fewer than 50 workers from having to pay these benefits if it would jeopardize the viability of the business. It is unclear how lenient the Trump administration will be with exemptions. There are of course exceptions to the above rules - some classes such as health care providers like hospitals and nursing homes can be exempted from the requirements. The above analysis of the bill is a general summary that applies to most, but not all employers. More to come. This should not be construed as advise from an attorney. SB778 was recently approved and signed into law to allow an extension for the mandatory sexual harassment training requirement. SB778 makes three helpful clarifications to California's new sexual-harassment-prevention training requirements contained in Government Code Section 12950.1. 1. It extends the deadline for most employers to comply with the new harassment training requirements from Jan. 1, 2020, to Jan. 1, 2021 providing additional time to train both their superviso...ry and nonsupervisory employees. 2. The new Jan. 1, 2021, deadline removes the prior concern that supervisors trained in 2018 would need to be retrained in 2019 to meet the 2020 deadline; it specifically provides that employers who conducted legally sufficient training in 2019 will not be required to provide further refresher training until two years thereafter and clarifies training must be done every 2 years. 3. It specifies that nonsupervisory employees must be trained within six months of hire.

To summarize (written by Comstock Magazine in article linked below): The April 2018 Supreme Court decision in Dynamex Operations West v. Superior Court of Los Angeles County set stricter rules for how companies use contractors. Since then, many businesses have waited to see how the state legislature would respond. ... We’re about to find out. A bill being furiously negotiated Assembly Bill 5 would codify the court’s strict ABC test for determining who is a legitimate contractor, with huge implications for the gig economy and employers who use contractors more broadly. The situation, says Amelya Stevenson of Granite Bay human resources consulting firm e-VentExe, is a hornet’s nest. What’s ABC? Think A for autonomous, meaning the worker must be free from control and direction by the employer over how and where they do the work, in the words of the court. B is for boundaries, with the work the contractor does required to be outside the employer’s usual course of business. And C is for company, as in the contractor must have a real one; they need to be customarily engaged in an independently established trade, occupation, or business. To be legit, the employer’s contracting arrangement has to prove all three. The penalties for getting it wrong most definitely qualify as more than a slap on the wrist: The employer who incorrectly classifies has to pay the unpaid state income tax, unemployment insurance and disability insurance that it should have paid were the contractor an employee. The IRS can charge back FICA and payroll taxes. And the employer could get a year in jail.
